Many of the callers and visitors to our CTUIR offices have asked about the second payments and delay---here is information that was provided to CTUIR staff :
Funding of the Indian Trust Settlement Account occurred at the end of November 2012. All funds not used for the Historical payout are in an interest accruing account at JP Morgan Chase. Any interest accrued on these funds will be kept within the Settlement and most likely used for land purchase and Indian Scholarship funds as there is an established formula for the payout for the Trust Administration Class that has been approved by the Court. A specific usage of the interest accrued has not been detailed in the Settlement Agreement. For more information, please visit www.IndianTrust.com.
We have been appointed by the court to act as a third-party administrator and would be happy to answer any questions regarding the Indian Trust Settlement. As a third-party administrator we are unable to provide information outside the scope of the Settlement. We do not have access to the exact amount of interest that has accrued in the Indian Trust Settlement fund account at any time.
The estimated date for commencement of payment of Trust Administration Class award has been adjusted due to several factors:
- The original dates for distribution were estimates based on the anticipated timeline for claim determination as the Settlement Agreement provides a period for potential Trust Administration Class members to file claims.
- The deadlines for filing claims was extended earlier this year to provide all potential claimants a reasonable opportunity to establish eligibility to participate in the settlement, particularly for those in areas such as Oklahoma where information regarding the ownership of trust or restricted land may not be on Interior’s land records systems. Payments cannot be made until final membership of the Trust Administration Class can be determined.
- The government shutdown unfortunately delayed the process and some information needed in order to make final award determinations.
- GCG must wait for the final information including award calculations to be received from the Interior as well as a Court Order approving the distribution before it can begin the process of cutting checks.
As several of the components noted are ongoing and have not yet been completed, we are updating the estimated payout time frame.

TRUST ADMINISTRATION CLASS PAYMENTS
EXPECTED IN 2014
Important Update: Trust Administration Class payments are expected to be mailed in 2014.
The Settlement Agreement approved by Congress and the Courts requires identification of all Trust Administration Class Members and calculation of their respective pro rata shares by the Department of the Interior ("Interior") before The Garden City Group ("GCG"), the Claims Administrator for the Cobell Settlement, can mail Trust Administration Class payments. That work is ongoing and is nearly complete.
After the membership of the Trust Administration Class is finalized, it will take Interior approximately a month to complete the calculations for the over 500,000 Trust Administration Class Members. Once GCG receives those calculations and the Court approves the Second Stage Distribution, GCG will quickly prepare and commence distribution within three weeks.
Thus, if the class membership is finally determined in December, the payments can then be made in the first quarter of 2014 barring any unexpected issues. Please be assured that all parties are doing everything possible to issue the Trust Administration payments as soon as possible. Any questions can be directed to the below:

May 16, 2012 update - There were no oral arguments scheduled for Tuesday, May 15, 2012, the judges will dispose|rule based on the information already presented. NO decisions have been made on the first appeal heard on 2/16/12 or the second appeal scheduled for 5/15/12. More to come when information is made available.
